U.s. Congressional Reconstruction Era - 844 Words

The Reconstruction Era In 1865, the city was devastated because of the crisis that left the civil war. Therefore, political, economic and social issues needed to be resolved to improve and reconstruct the Nation. It was the period in which the State and local governments in the South were restored, and the Southern states were unified to the rest of the States. This essay emphasizes the differences between congressional and presidential reconstruction. Also, it highlights the achievements and success of both. Although the presidential and congressional Reconstruction has some similarities, they also disagreed on many points and created a conflict between each other. Nevertheless by early 1867, the new Congress passed the Reconstruction Act of 1867 over President Johnson’s veto. The Congressional Reconstruction Plan dramatically changed politics in the South. The reconstruction was a process of reformation that affected the whole nation. There were three main Reconstruction plans. Two were presidential â€Å"The Lincoln and Johnson’s Plan. Meanwhile, one was Congressional. Lincoln started a Reconstruction plan during the Civil War. To summarize, he implemented before his death, the Emancipation Proclamation, the 10% Plan and he tried to extend suffrage. But his Plan failed. Machiavelli’s La Mandragola is a satire which focuses on major flaws in the world: the corruption and immorality of the Catholic Church. There are over 750 stores across Australia (Coles.com.au 2017). Coles needs a healthy workforce as it develops a positive and caring image. A healthy environment can be created for the employees by enhancing self-esteem and improving their morale. Coles is committed to provide a healthy and safe work environment by managing the risks and hazards at the retail stores. The supermarket sells grocery products and services, bakery items, dairy products, liquor and thousands of other products. Coles is governed by legislation and self-insurance requirements and look for opportunities to improve (Coles.com.au 2017). Importance of Workplace Health and Safety at Coles Every workplace is bound by legal regulations to comply with occupational health and safety. Every workplace might cause injuries and accidents resulting in direct and indirect costs. Coles faces certain obstacles on a regular basis. The food supermarkets and grocery stores are filled with possibilities of fall and slip injuries. If the obstructions are left in the aisles such as poorly shelved items, it may drop overhead causing a fall (Safeworkaustralia.gov.au 2017). Further, faulty refrigeration can cause water leakage forming puddles around freezer shelves and displays. A few obstructions are broken jars with its filling oozing, dropped canned goods and fruits and vegetables in the aisle (Anderson and Chun 2014). Coles is legally under the duty to keep its aisles free on a regular basis. They can do things like train the store employees so that the store manager is informed immediately. Further, the workers at Coles can be trained to keep aisles safe by quickly removing fallen items, like fruits or chip bags (Safeworkaustralia.gov.au 2017). Further, the supervisors must train the employees to make displays and stocks as a design to prevent injury (Safeworkaustralia.gov.au 2017). The employees at Coles must keep all walkways, selling areas, parking lots and checkouts free from hazardous conditions (Safeworkaustralia.gov.au 2017). If Coles fails to meet the duty of care, they may be liable to legal compensation both employees and customers who suffer the damage (Akbar and Ahsan 2014). The employees need to be aware of the loose produce that can fall off to the floor of supermarket. The sections at Coles are filled with freezers, tanks of waters and others that may accumulate water. According to Gardiner (2013), Coles was sued by a Sydney woman as she slipped in the supermarket on two pieces of cardboard. It was found that the pieces of cardboard had fallen due to lack of negligence of the staffs. Therefore, the company had to pay an amount of $120,000 as damage for compensation (Gardiner 2013). The lady knocked over rows of dips and cheeses and was unable to perform daily activities due to injury in her back and arm (Gardiner 2013). Another case was reported by a woman aged 50, who fell on a puddle in the Coles supermarket (Peters 2016). She twisted her ankle and was unable to carry out her domestic activities, recreational and social activities. Coles was ordered to pay the woman $280,000 plus litigation fees as a compensation to the woman (Peters 2016). According to Byrne (2017), a former Coles employee won $1 million as he feel off the stool at work. The woman used to work in 2009 and fell off the safety step while she was straightening shelves (Byrne 2017). The woman claimed that she received no training after she joined the supermarket and injured her hip. She had to undergo several medical treatments as she copied the other workers footsteps without training. This implies that Coles does not provide proper training to its employees so that accidents and injuries are least (Byrne 2017). According to Safe Work Australia, workplace health and safety practices are necessary as it ensures safety of the employees (Safeworkaustralia.gov.au 2017). In case of accident at Coles, the employees must call their nearest manager and supervisor. The supervisors must witness the context of the scene. The manager must write an accident report. In case of a serious injury, the manager can call an emergency contact number. If the injuries are not serious, first aid may be provided to the employees (Pitt 2016). However, the managers must look for eye witnesses who can testify the depositions. Positive relationships can be built if the employees are properly trained. Obligations in Relation to Larry liability and the Wrongs Act 1958

In your answer consider negligence,vicarious liability and occupiers liability and the Wrongs Act 1958? Answers: 1. Larry is the permanent staff of the restaurant that usually comes in Tapas restaurant to consume Spanish food and sangria. Issue arises when he is drunk and out of control. Often his nature changes and he behave badly with the staffs and clients in the restaurant. According to Liquor Control Reform Act 1998-section 3AB coordination of behaviour after consumption of liquor is not allowed. It is not allowed that after drinking the misuse and abuse of alcohol should not be done. Adequate supply and control over alcohol is restricted. As a licensee of Tapas restaurant it is the responsibility of the licensee to follow the structure of the act. As per section 824B of Corporation Act 2001 in hotel premises and restaurants are not allowed to do any abusive behaviour after drinking alcohol[1]. If the breach of rules of liquor act is done then as per section 4 of Liquor Control Reform Act 1998 if regulation in the restaurant is not maintained then the licensee can take the harmed person to court and for explicating and abusing hex may be punished under Corporation Act[2]. The obligations are to conduct disclosure, use provisional financial service; maintain risk management, work with technological ending. The obligations and rights of the licensee are to fulfil the responsibility service of the alcohol; look after the fire safety; required signage; specific conditions limitation. It is needed that records should be kept by the restaurant and by that the licensee can penalised if any harm is obtained by the other clients. There are several clients in a restaurant who consumes alcohol. This needs Alcohols license with obligation that if the person misbehaves with any of the staffs and the customers then the person may be thrown from the restaurant and in charge penalty may be asked from that person[3]. Under the club license act it is necessary that several premises structures are needed to be carried which may helps in carrying forward the obligations, rights and other duties. For the staffs and the clients every possible steps are needed to be followed appropriately through which change can be brought and if the warning is given to the customers like Larry then they would never perfor m such acts. This may help in structuring and controlling the possible changes in the restaurant and other premises following several dimensions and change which is needed to be brought. 2. At Friday night after leaving the restaurant he was seriously injured. In this case the licensee of the restaurant is non-vicariously liable. He was personally liable for his condition because he was in an intoxicated condition and he used the toilet which is in the backside of the restaurant. In this case Larry is himself liable for the negligence and carelessness performed by him. In this case Occupiers liability act 1984 is responsible because an occupier imposes liability in the maintaining the land which has been made by them. The infrastructure of the toilet is problematic because there is a reason that degree of control has caused the main problem which is the reason those certain conflicts has been raised[4]. This is the duty of the owner of the restaurant to do maintenance of each part of the building but as the toilet was too maintained so Larry was injured. In this case partial duty of the occupier is to maintain the balance of the work of the organization. It is necessary that implied license of legal consideration is needed to be practiced. In this case allurement principle is also balanced because it is common duty of care of the staffs to help the customers. As the staffs have noticed that the condition of Larry was very adverse so it is necessary that the staffs should have taken Larry to any taxi or car in a safe way by seeing his adverse intoxi cated condition. It is necessary that several structures of the premises is needed to be followed through which the organizational benefit in the restaurant is matched. It is necessary that defences on occupiers liability is needed to be fulfilled which may help in carrying forward the structural plans of standard care. It is necessary that standard of care is maintained[5]. Contributory negligence is done in this case because there are different objectives which are needed to be followed in a structural way through which liability is concerned. In this case as both have equal liability so no one is concern about the ramifications. No one can be directly blamed for the injury of Larry as himself he was in a drunk state and under Liquor Control Reform Act 1998-section 3AB no one is allowed to abuse someone in a drunken condition. It is necessary that different structures of Occupiers liability act 1984 is needed to be fulfilled through which license act can be fulfilled. Liability in respect of intoxicated plans is needed to be progressed. These types of acts should be balanced with several conditions which are needed to be balanced. This can prove that the licensee is not vicariously liable for the injury of Larry but the owner was vicariously liable under occupiers liable act. If the balance of the cat is maintained properly then change can be progresse d with the action and planning conditions which helps in carrying forward the balancing nature of the organization or restaurant. In this case Larry cannot sue the restaurant under Wrongs act 1958.
